Jackie Walorski Replacement - Elkhart, Ind. (AP) - A staff member for U.S. Representative Jackie Walorski was trying to pass a flatbed truck on a highway in northern Indiana last month when the SUV they were driving crashed into an oncoming car, killing Walorski and three more, police said Friday.
A witness riding behind the SUV told investigators it accelerated, crossed the center line of the two-lane highway as it approached the truck and pulled into the path of another vehicle when the crash occurred around 12:30 p.m. Aug. 3, according to the Elkhart County Sheriff's Office.

Air bag control module data from the SUV driven by 27-year-old Zachery Potts, who was a Walorski district director, showed he was going 77 mph at the time of the crash on a rural stretch of Indiana 19 near the town of Wakarusa, the office said.

"All the evidence and information gathered is consistent with someone attempting to pass another vehicle on a two-lane road," the office said in a statement.
Walorski, 58, was a Republican who was first elected to represent northern Indiana's 2nd Congressional District in 2012 and is seeking re-election to a sixth term this year.
The sheriff's office released a statement from the county coroner that Walorski and the others suffered in the accident were accidental deaths. Investigators blamed Potts for the crash "driving left of center with a contributing factor of excessive speed."
Also killed in the crash were Emma Thomson, 28, who was Walorski's communications director, and Edith Schmucker, 56, of Nappanee, Indiana, who was driving the other vehicle.

The sheriff's office said investigators found no signs of mechanical failure in the vehicle at the time of the crash or evidence of anyone using a cell phone in the vehicle.
Republican officials selected Rudy Yakim, an executive at Elkhart distribution company Chem Crest and a longtime political ally of Walorski, to replace him on the November election ballot in the GOP-heavy district. The district's congressional seat will be vacant until a special election is on the ballot in November to end Walorski's term for the remainder of this year.
"The Supreme Court shouldn't be pinging up and down based solely on whatever the latest election results are," Johnson said.

Indiana's governor on Tuesday officially called a special election to fill the congressional seat left vacant after U.S. Rep. Jackie Walorski, R-2, was killed in a car crash.
Walorski's pending special election will be held at the same time as the Nov. 8 general election, according to Gov. Eric Holcomb. His position must be filled under United States and Indiana law for the current term because the vacancy occurred more than 74 days before the general election.

Republican leaders in the 2nd Congressional District, which includes South Bend and Elkhart, must select a nominee to replace Walorski on the general election ballot. He was seeking another term in the heavily Republican district through January 2023.
The congressman received the Republican nomination in May and was scheduled to defend his congressional seat against Democratic challenger Paul Steury in November.
But who will vote for Walorski's interim successor and his successor will be different. That's because some Hoosiers saw their 2022 congressional districts change during Republican-led redistricting.
Some voters in the 2nd Congressional District - as currently drawn - will only be eligible to vote in the special election Other voters drawn in districts under the new map will only be able to vote in the November election .
Five Republicans Seek Walorski's Old Congressional Seat
The Republican and Democratic parties will first decide who to nominate for the special election.
Indiana Republicans will also caucus to select a candidate to fill Walorski's position on the Nov. 8 general election ballot.
Indiana GOP Chairman Kyle Huffer on Tuesday officially called two caucuses of qualified center committee members to fill vacant seats for the separate special and general elections. They are due to meet in Mishawaka on August 20th.
"We are still shocked by the tragic death of Representative Jackie Walorski and are not ready to talk about next steps," Huffer said in a statement. "Unfortunately, Indiana code requires us to move much faster than anyone would like."

The Indiana Republican Party generally has 30 days to fill a vacant seat, Indiana Code requires that a certificate of nomination be filed with the Indiana Department of Elections no later than noon, 74 days before the election date, which means half day, August. 26.
The Democrats nominated Stewery for the November general election in the primary in May 2022. The Liberal Party candidates for the general election were also appointed following the state convention of the Liberal Party.
This means that the Democratic and Liberal parties do not need to take steps to nominate candidates for "new" congressional districts in the general election. The deadline for filing candidates for an independent or other minor party for the November general election has already passed.
The same candidate is likely to win both elections. But if two different candidates win the special and midterm elections, the winner of the special election will serve until Walorski's term ends on Jan. 3, 2023. But some voters in Cass, LaPorte and Kosciusko Counties won't have the special and general election questions for the 2nd Congressional District on the November ballot. Before redistricting, parts of these counties were included in other congressional districts, making voters there ineligible to participate in special elections.
Only new term candidates will appear on the November ballot for voters in other areas of the three counties now in the 2nd Congressional District.

Walorski, a native of South Bend, was 58 years old when he died. He has served in the US House of Representatives since 2013 and previously spent five years in the Indiana House. He was seeking a sixth season this fall.
A special election was previously held in 2010 for Indiana's 3rd Congressional District, which includes Fort Wayne, to fill the seat vacated by former Republican Representative Mark Souder. Souder withdrew his re-election bid after the May 2010 primary after admitting to having an affair with a female employee. A special election was called by then Government Mitch Daniels to be held at the same time as the November mid-term elections, and he said it would be less expensive for the county and more convenient for voters.
